Terms of use and engagement

These terms cover the use of this website, the sale of my TradingView indicators and my NinjaTrader 8 indicators on it, and the basis on which custom development work is agreed.
The website
The content of this site is provided for information about my work. It is not investment advice and it is not an offer to trade on anyone's behalf. Figures shown for past work are historical Strategy Tester or cTrader backtest results, or demo-account forward tests on Myfxbook, under the conditions stated next to them; they are not a prediction of future results.
Buying a TradingView indicator
The invite-only TradingView indicators listed under TradingView are sold on this site by me, Kestutis Balciunas. My MetaTrader and cTrader products are sold by their own stores under those stores' terms, not here. The NinjaTrader 8 editions are sold on this site as well; their terms are in the next section.
What you buy. A personal, non-transferable licence to use one indicator on one TradingView username, for as long as the indicator is published, with every later update included. The price is the one shown on the indicator's page, in US dollars, paid once. There is no subscription and no renewal.
Payment. Payments are taken by Stripe or by PayPal on their own pages. I never see or store your card details.
Delivery. After payment you send me your TradingView username through a short form. I grant access by hand from my TradingView profile, normally within a few hours and always within 24 hours of receiving the form. You need a TradingView account; the free plan is enough.
Refunds. Access to an invite-only script cannot be returned once it has been given, so a sale is final once access has been granted. If you have paid and access has not been granted yet, email me and I will refund you in full. Every indicator's script page on TradingView is public, so you can read the full description and see it on charts before you buy. Nothing in this paragraph limits rights you have under the consumer law of your country.
What you may not do. Share your access, resell it, or attempt to copy or redistribute the script. I may withdraw access that is being shared or resold, without a refund.
Changing your username. If you change or replace your TradingView account, email me from the address you bought with and I will move the access.
What an indicator is. An analysis tool that marks conditions on a chart. It does not place trades, it does not predict prices, and it is not financial advice.
Buying a NinjaTrader 8 indicator
The NinjaTrader 8 indicators listed under NinjaTrader are sold on this site by me, Kestutis Balciunas. NinjaTrader is the platform they run inside, not a broker; NinjaTrader is a registered trademark of NinjaTrader Group, LLC, and no NinjaTrader company has any affiliation with me or any interest in these products.
What you buy. A personal, non-transferable lifetime licence to use one indicator on one NinjaTrader account login, on every installation of NinjaTrader 8 Desktop you log in to with that account, with every later update included. The price is the one shown on the indicator's page, in US dollars, paid once. There is no subscription, no renewal and no free trial.
Payment. Payments are taken by Stripe or by PayPal on their own pages. I never see or store your card details.
Delivery. After payment you send me the email address you log in to NinjaTrader with, through a short form. I issue the licence by hand in NinjaTrader's Vendor Dashboard, normally within a few hours and always within 24 hours of receiving the form, and email you the download link and the installation guide. You need NinjaTrader 8.1 Desktop for Windows and a NinjaTrader account; the free platform and its simulation connection are enough.
Refunds. A licence on your NinjaTrader account cannot be handed back, so a sale is final once the licence has been issued. If you have paid and the licence has not been issued yet, email me and I will refund you in full. Every indicator's user guide is public on its page, so you can read exactly what it does before you buy. Nothing in this paragraph limits rights you have under the consumer law of your country.
What you may not do. Share your NinjaTrader login so that others use the licence, resell it, or attempt to decompile, copy or redistribute the package. I may revoke a licence that is being shared or resold, without a refund.
Changing your account. If you change or replace your NinjaTrader account, email me from the address you bought with and I will move the licence.

Custom development
Work ordered through Upwork is governed by Upwork's terms of service and its milestone and escrow system. Work agreed directly by email follows a written specification that I send back before any payment is made; the specification, its price and its delivery terms form the agreement.
On delivery you receive the source code of the work and may use and modify it for your own trading. You may not resell it as your own product without a separate written agreement. I keep the right to reuse general techniques and non-client-specific code in other work.
No performance promises
I do not promise profit, win rates, returns or the outcome of any prop-firm evaluation. What I deliver is software that does what the specification says, tested under the conditions written in the report. How and whether you run it is your decision and your responsibility.
Liability
To the extent permitted by law, my liability for any work is limited to the amount paid for that work. I am not liable for trading losses, missed profits, broker or platform failures, or the consequences of running software in conditions it was not specified for.
Governing law
These terms are governed by the laws of the Republic of Lithuania.
